General Terms and Conditions

Preamble

The General Terms and Conditions give you an overview of our services on Tellknives.ch. We offer you a personalized shopping and service experience for the various items of cutlery and equipment selected and distributed by Tellknives.ch. The items available on the online shop are not necessarily in stock and may have to be ordered from our suppliers as soon as the order is received by our customer.

Tellknives is a Swiss company registered in the Commercial Register of the Canton of Vaud under the name : Tellknives - Matthias Morel. In Switzerland, the items sold on our site are not considered as weapons within the meaning of the Federal Law on Weapons (LArm of 20.06.1997). With regard to the countries and other legislation in force, it is the customer's responsibility to verify the legality of importing and possessing the item purchased. Tellknives cannot be held responsible for the non-observance of the law in force by its customers in their respective countries, other than Switzerland. Any dispute resulting from the non-observance of the laws and rules in force in the buyer's country is the sole responsibility of the buyer.

Orders placed on the shop are binding on the customer as soon as the order and payment have been received by our customer service department. In the case of payment by bank transfer, credit card or Paypal, orders placed on the server are binding on the customer upon receipt of the order by our customer service department. We will confirm receipt of your order by e-mail immediately after payment has been received. In the case of non-immediate payments (bank transfer and invoice), we kindly ask you to transfer the purchase price immediately after ordering, in a single payment, but within seven days at the latest.

Please note that we do not assume the risk of having to purchase ordered goods (supply risk). Not all the items we offer are in stock at Tellknives, so they are marked “available” or “unavailable” rather than “in stock” and “out of stock”. Available items are either in stock or available to order from our supplier. 

Any order implies full acceptance of these terms and conditions of sale. The items offered for sale on Tellknives.ch are not for sale to minors. By placing an order on the site, the customer confirms that he/she accepts the general terms and conditions of sale and is at least 18 years of age.

We reserve the right not to accept or to cancel an order if it has been placed using software, robots, web crawlers, web spiders, automated systems or scripted behavior of any kind, and using third-party services to place an order on your behalf.

Delivery and orders

Subject to unforeseen circumstances, stock shortages or supplier lead times, products are normally delivered within 10 working days (but generally between 5 and 7 working days) in Switzerland after validation of your online payment (immediate) or validation of your bank transfer (2 to 3 working days). International deliveries may take longer, as they involve national post offices with varying delivery times.

We deliver your orders in Switzerland and abroad. If the delivery time is given in working days, this means all days from Monday to Friday, excluding public holidays.

The delivery times mentioned at the time of purchase are given as an indication only. If the product is temporarily out of stock at the supplier's, this lead time cannot be met. Tellknives will inform the customer of any possible extension of the lead time.

Likewise, we are exceptionally not obliged to deliver the goods ordered if we have duly ordered them on our side but have not received delivery correctly or on time. We are not obliged to deliver the goods if we are not responsible for the lack of availability of the goods and have informed you immediately. If the goods ordered are not available, we will immediately refund any payments already made.

All goods are inspected and checked by Tellknives before dispatch to ensure quality and condition. Delivery is deemed to have been made as soon as the product has been dispatched by post to the customer. It is the customer's responsibility to check the product on arrival and to inform Tellknives of any justified complaints. Complaints may be made by registered letter or e-mail within 5 days of receipt of goods. 

The risks associated with delivery are borne by the purchaser as soon as the parcel has been delivered by our partner. Tellknives ships all its parcels using a delivery method that guarantees tracking of the shipment by the customer throughout the delivery process. If the post office has delivered the parcel, Tellknives cannot be held responsible for the absence of the parcel or its disappearance at the delivery address. Furthermore, Tellknives cannot be held responsible for the disappearance, loss or theft of a parcel once it has been handed over to the carrier.

It is the customer's responsibility to provide a precise and accurate delivery address on their customer account. In the event of a move or any other change of address, the customer is required to update the information on his account. Tellknives reserves the right to invoice the cost of shipping to another address in the event of returns due to incorrect or inaccurate addresses, or in the event of packages not being collected.

Our offices are closed on Saturdays and Sundays, as well as on public holidays (corresponding to the Swiss national calendar). However, the online shop remains active, but orders are processed during office opening hours.

We are released from our delivery obligation in the event of fortuitous events or force majeure. By way of example, floods and fires are cases of force majeure. Tellknives is also released from the obligation to deliver on time in the event of goods being detained by customs, during the random checks frequently carried out in our field of activity.

In the case of export sales, we accept no liability for non-compliance with local legislation and customs regulations. Import taxes, customs duties and other taxes specific to certain countries are entirely at the customer's expense.

Prices

Prices shown include VAT for Switzerland, but exclude shipping costs.

We may modify our prices at any time. The customer undertakes to pay the selling price in force at the time the order is entered. Payment is due in advance, in a single instalment.

For Switzerland, a flat-rate delivery charge of CHF 7.00 applies to all orders under CHF 300.00. Orders of 300.-CHF or more are shipped free of charge.

We recommend that you group all your items in a single order. This will enable you to benefit from free delivery within Switzerland. If you place two separate orders, there is no guarantee that we will be able to combine them, so shipping charges will apply to each of them.

For foreign orders, shipping costs are calculated on a case-by-case basis, according to the weight and volume of the order. There is no threshold for free shipping abroad.

Regarding the use of vouchers: promotional vouchers issued as part of advertising campaigns or purchased gift vouchers may also be used as part of the ordering process. The respective voucher conditions apply.

Description 

The characteristics, dimensions and specifications of the equipment presented on our site are for information only. They may be modified without prior notice, particularly in the event of technical developments or changes by our suppliers to their product ranges. The characteristics shown on our site, including photos, are not contractual and may be changed without notice.

Right of withdrawal and return of goods

In accordance with Swiss law, the customer has no right of withdrawal. Goods may only be returned on exercise of the manufacturer's warranty in the event of a defect. If the manufacturer refuses to accept a warranty claim for reasons which he considers unjustified, Tellknives cannot be held responsible for the non-exercise of the warranty and defers to the manufacturer's opinion. In this case, no refund or exchange can be requested from Tellknives.

In the event of hidden manufacturing faults or defects, the product must be returned to us by the customer. The product will be exchanged or repaired. This contractual warranty excludes the following damages:

- Products that have been disassembled.

- Damage, failure or defect due to external causes.

- Damage due to corrosion or oxidation.

- Improper use of the product.

The manufacturer will be the judge in determining whether the repair will be made with or without charge. Only products with a proven defect will be accepted. Otherwise, your product may be returned to you, at your expense, or your return may be requalified under the appropriate reason.

Terms of payment

Our products are payable online: by credit card, Postfinance card and E-finance, and Twint.

Our items are payable offline: by bank transfer to our account or by invoice (QR code).

In all cases, the amount of the order must be paid in a single instalment and only the receipt of the amount validates the order.

Reservation of ownership

The transfer of ownership of goods delivered is subject to full payment of the invoice due in advance. In the event of non-payment, the seller will cancel the order and the customer will have to place a new order to obtain the goods.

Protection of personal data

All the information and measures taken by Tellknives with regard to data protection are available in our Privacy Policy, available on every page of our online shop.

The protection of customer data is a priority for Tellknives and all the data you entrust to us is solely intended to enable us to process your orders.

The customer has the right to access, consult, modify, rectify and delete the data provided.

Tellknives undertakes not to divulge customer data to third parties under any circumstances.

Disputes

By placing an order, the customer accepts, without restriction, the general terms and conditions of sale of our website.

Tellknives reserves the right to refuse orders from a customer with whom the company encounters payment problems, disputes, non-compliance with the general terms and conditions of sale, or any other infringement of the company's image (social networks, etc.). Any dispute relating to the sale (price, terms and conditions, product, etc.) will be subject to Swiss law before the Vaud cantonal court.

General terms and conditions

You can view these GTC at www.tellknives.ch. In addition, you can print or save this document using the usual function of your Internet browser (= usually “File” -> “Save as”). You can also download this document as a PDF file and archive it. To open the PDF file, you need the free Adobe Reader program (at www.adobe.ch) or a similar program compatible with the PDF format.

Should individual provisions of the contract, including these regulations, be or become wholly or partially invalid, or should the contract contain an unforeseen loophole, the effectiveness of the remaining provisions or parts thereof shall not be affected. Ineffective or missing provisions are replaced by the corresponding legal regulations.

The offers on www.tellknives.ch may only be used by persons aged eighteen (18) or over.

We reserve the right to change these terms and conditions at any time.
